These Terms of Use govern your access to and use of the Optimasoft website, operated by SODO TRADE Ltd. By accessing or using the site, you accept these terms. If you do not agree, please do not use the site.

2. Scope: website vs. customer agreement

These terms govern your use of this website. Access to and use of the Optimasoft software products and services are governed by a separate written agreement (Master Subscription Agreement and Data Processing Agreement) entered into between Optimasoft and the relevant customer. In case of conflict, the signed agreement prevails over these terms.

3. Eligibility

The site is intended for business users and professionals. By using it, you confirm that you are at least 18 years old and authorised to act on behalf of the organisation you represent. The site is not directed at consumers within the meaning of consumer law, nor at children.

4. Acceptable use

We grant you a limited, non-exclusive right to view the site content for informational purposes and to evaluate our products. You may not:

• copy, scrape or automatically harvest content;
• reverse engineer or attempt to bypass security;
• use the site to violate any law or third-party rights;
• introduce malicious code or overload the infrastructure;
• misrepresent your identity.

5. Intellectual property

All site content - text, graphics, design, software, logos and trademarks - is owned by SODO TRADE Ltd. or its licensors and is protected by law. "Optimasoft", the product names and logos are trademarks. No rights in them are granted to you beyond the limited right in section 4.

6. Demo requests and forms

Submitting a form or a demo request does not create a contract. By submitting, you agree that we may contact you regarding your enquiry. The processing of your personal data is described in the Privacy Policy.

7. Third-party links

The site may contain links to third-party websites. We are not responsible for their content or practices.

8. Site availability

The site is provided "as is" and "as available". We do not guarantee uninterrupted or error-free access and may modify or suspend it at any time. Product availability commitments (SLA) are governed by the customer agreement, not here.

9. Disclaimer of warranties

To the maximum extent permitted by applicable law, the site content is provided without warranties of any kind, including as to accuracy, fitness for a particular purpose or non-infringement. Marketing content is informational and does not constitute a binding commitment about the products.

10. Limitation of liability

To the maximum extent permitted by applicable law, Optimasoft is not liable for indirect, incidental or consequential damages arising from use of the site. Nothing in these terms excludes or limits liability that cannot be excluded by law (including for intent or gross negligence).

11. Data protection

The processing of personal data via the site is described in the Privacy Policy. The processing of customer data within the products is governed by the separate Data Processing Agreement (DPA).

12. Changes to these terms

We may update these terms. Changes take effect upon posting on this page with a dated notice. Continued use of the site means acceptance of the current version.

13. Suspension of access

We may restrict or terminate your access to the site at our discretion, including in cases of abuse or breach of these terms.

14. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Bulgaria. Any dispute arising out of or in connection with them shall be referred to the competent court at the company's seat in Varna, without prejudice to mandatory consumer-protection and data-protection rules.
